LEASE AGREEMENT
This AGREEMENT made this __________________ by and between ________________,(hereinafter referred to as LESSOR) and __________________ (hereinafter referred to as LESSEE). WITNESSETH WHEREAS, Lessor is the owner of a Certificate of Public Convenience with the right to operate one (1) taxicab upon call and demand in the City of Philadelphia, namely taxicab No. P-______. WHEREAS, Lessee is desirous of leasing the taxicab now owned and operated by Lessor; and NOW THEREFORE, the parties intending to be legally bound hereby agree as follows: 1. Lessor shall lease to Lessee the taxicab of Lessor for a period of one (1) year, commencing at the execution of this Agreement. 2. Lessee shall pay to Lessor the sum of $_______ per week, payable on Monday of each week. 3. Lessor shall furnish a taxicab, meter, roof light and a two-way centrally operated radio system. The vehicle in question shall be kept at a specifically designated garage or parking location when it is not being used in the public service. 4. Lessor reserves the right to assign and transfer his interest under this Agreement to a corporate entity at any time whatsoever during the term of this lease. 5. Lessor shall obtain and satisfy all expenses concerning the insurance requirements of the Commonwealth of Pennsylvania and Philadelphia Parking Authority with respect to this taxicab. 6. Lessee shall not sell, assign, convey, encumber or otherwise transfer any of the obligations undertaken by him pursuant to this Agreement. 7. Lessee shall be responsible for all fines and legal expenses lodged against this taxicab during the term of this agreement. 8. Lessee shall operate this taxicab pursuant to the Rules and Regulations of Philadelphia Parking Authority and any and all other governmental agencies. Lessor may, at his option, terminate this Agreement, if Lessee violates any of the above rules or regulations. 9. Lessor shall join a centrally dispatched radio system, and pay all dues and assessments arising out of said membership. 10. The driver/lessee of this vehicle shall be required to keep daily log sheets and transfer said log sheets to Lessor. The Lessee and Lessor shall be required to furnish and maintain adequate service to the public which shall be reasonably continuous and without unreasonable interruptions or delays. 11. Lessee shall perform daily safety inspections of the operating equipment to insure that such equipment is in safe and working condition. Lessee shall be responsible for the mechanical maintenance of said vehicle, which includes maintaining the exterior and interior of the vehicle. Lessee shall further be responsible for insuring that the vehicle receives state inspections. Lessee shall be responsible for all gasoline used or consumed by said taxicab. 12. Lessee agrees to adhere to regular shifts of operation and Lessor shall utilize disciplinary procedures as to the Lessee/driver failing to adhere to these shifts. 13. Lessee agrees to answer all radio dispatches promptly and Lessor will penalize Lessee if said radio dispatches are not promptly answered. 14. Lessee is considered an independent contractor and workers’ compensation insurance is not required to satisfy his taxes as a self-employed independent contractor. Lessee shall be responsible to pay his/her taxes. 15. All notices required to be given under the terms of this Agreement, shall be in writing, shall be effective upon receipt and shall be delivered to the addresses in person or mailed by Certified Mail, Return Receipt Request, to the following addresses:

This AGREEMENT has been negotiated and executed in the Commonwealth of Pennsylvania and the laws of the state shall govern its construction and validity.
